Effective January 1, 2027, the USPTO will incorporate the latest classification changes adopted under the Nice Agreement — the international system for classifying goods and services in trademark registrations (91 Fed. Reg. 54963, Aug. 26, 2026).

Classification changes sound administrative. They're not. The class and identification you file under determines your filing fees, determines what your registration actually covers, and determines whether an examiner issues an Office Action requiring you to reclassify — which costs time and money.

How to apply it in practice

  • Review pending applications. If you have applications pending as the new year approaches, check whether your identifications of goods and services are affected by the updated classifications.

  • Plan upcoming filings around the change. If you're filing in late 2026, consider whether waiting until the new classifications take effect — or filing now under current ones — produces cleaner protection. The answer depends on the goods and services at issue.

  • Audit existing registrations before renewal. Misclassified goods can complicate Section 8/9 renewal filings. A quick classification review now is cheaper than an Office Action later.

Classification is one of those details that's invisible when it's right and expensive when it's wrong. The January 1 update is a good excuse to get it right.
